Hercules Privacy Policy

This Privacy Policy describes how Hercules Fitness, LLC ("Hercules," "we," "us," or "our") collects, uses, and shares your personal information when you use our mobile application, our website at joinhercules.fit, and related services (together, the "Services"). Hercules is the controller of the personal information described in this Policy.
This Policy is part of, and incorporated into, our Terms & Conditions. Please also see our Cookie Policy, which explains the cookies and similar technologies used on our website.
The short version. Hercules is a personal fitness app. We collect what we need to run the app and your account, process your subscription, and support you. We do not sell your personal information, and we do not use it for third-party or cross-context behavioral advertising. We never use your health or fitness data for advertising, and we never sell it.
1. Scope
This Policy applies to personal information we process about users of the Services in the United States. The Services are intended for users in the United States and for people who are 18 or older. It does not apply to third-party services we do not control (see Section 4).
2. Information we collect
2.1 Information you provide
- Account information. When you create an account, we collect your phone number (used for sign-in through Firebase Authentication) and your name. You may also add an email address.
- Health and fitness profile. Information you choose to enter, such as gender, date of birth, height, and weight.
- Workout data. The training information you create in the app — workouts, exercises, sets, reps, weights, effort (e.g., reps-in-reserve), notes, distance and duration for cardio, personal records, custom workout templates, training targets, and favorites.
- Checkout information. When you subscribe on our website, you provide your email and phone number. Your payment card and billing details are collected and processed by Stripe, our payment processor. We do not receive or store your full payment card number — we receive limited details such as the last four digits, billing information, and subscription status.
- Support and communications. Information you provide when you contact us (for example, at support@joinhercules.fit) or respond to our messages.
2.2 Information collected automatically
- On-device data. To make the app work offline and load quickly, we store some of your data on your device (for example, your workouts and a cached record of your subscription status).
- Operational and log data. When you use the Services, our infrastructure providers (Firebase and Stripe) generate technical and security logs — for example, timestamps, device/connection information, and diagnostic data — that we use to operate, secure, and troubleshoot the Services.
- Cookies (website). Our website uses only essential/functional cookies and similar technologies. We do not use advertising or cross-site tracking cookies. See our Cookie Policy for details.
We currently do not use third-party analytics, advertising, social-media, or telemetry/tracking technologies in our app or website. If this changes, we will update this Policy before those technologies go live and obtain consent where required by law.
2.3 Information from other sources
- Stripe. After you subscribe, we receive subscription and customer details from Stripe — such as your Stripe customer and subscription identifiers, subscription status and renewal date, limited billing details, and any creator/partner code used at checkout (for attribution).
- Apple App Store and Google Play. If you purchase through an app store, we receive your purchase and subscription status from Apple or Google.
- Health platforms (optional, where available). If you choose to connect Apple Health (HealthKit) or Google Fit, we receive the health and fitness data you authorize (such as workouts or body metrics). You control this connection and can disconnect it at any time in your device settings.
2.4 Sensitive information
Some of the information above — including your health and fitness data — may be considered sensitive under applicable law. We treat this information with additional care, and we do not use it for advertising and do not sell it. See Section 6.
3. How we use your information
We use personal information to:
- Provide the Services — create and manage your account; save and display your workouts, templates, targets, and progress; and personalize your in-app experience based on your own data.
- Process your subscription — start, renew, and manage your subscription and free trial; apply creator/promo codes; and confirm your access to paid features.
- Communicate with you — send transactional and service messages (for example, login codes, receipts, security alerts, and important notices about the Services, these Terms, or this Policy), and — if you have not opted out — marketing emails such as newsletters and promotions.
- Support you — respond to your requests and troubleshoot issues.
- Maintain security and integrity — authenticate users, prevent fraud and abuse, and protect the Services and our users.
- Improve the Services — understand how the Services are used and develop new features (using aggregated or de-identified information where practical).
- Comply with law — meet our legal, tax, and regulatory obligations and enforce our agreements.
We do not use your information to make decisions that produce legal or similarly significant effects about you through solely automated means.
4. How we share your information
We share personal information only as described below. We do not sell your personal information, and we do not share it for third-party or cross-context behavioral advertising.
- Service providers. We share information with providers who help us operate the Services under contract and only as needed to perform their functions — for example, Google Firebase (authentication, database, cloud functions), Stripe (payment and subscription processing), Vercel (website hosting), and other providers for email/communications and customer support.
- App stores. Apple and Google process in-app purchases and provide us related subscription status.
- Creators and partners. Where you sign up through a creator/partner code, we share attribution and aggregate statistics with that creator or partner (for example, how many subscriptions their code generated). We do not share identifiable personal information about individual users with creators or partners. Attribution may be processed through our own proprietary affiliate-tracking tool or a third-party tool used for the same purpose.
- Legal and safety. We may disclose information if we believe it is reasonably necessary to comply with the law or legal process; to enforce our Terms; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of Hercules, our users, or others.
- Business transfers. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction, consistent with this Policy and applicable law.
We may also share aggregated or de-identified information that cannot reasonably be used to identify you.
5. What we do not do
To be clear about our commitments:
- We do not sell your personal information.
- We do not share your personal information for third-party or cross-context behavioral advertising.
- We do not run third-party advertising in the Services today, and we do not use third-party analytics or tracking SDKs today.
- We never use your health or fitness data for advertising, and we never sell it.
If we ever introduce advertising or analytics, we will update this Policy first and obtain your consent where the law requires it. The commitment regarding health and fitness data in the last bullet above will continue to apply regardless of any future changes.
6. Health and fitness data
Your health and fitness data — including the profile information you enter (gender, date of birth, height, weight), your workout data, and any data you connect from Apple Health (HealthKit) or Google Fit — is important and sensitive. We are committed to the following:
- We use this data only to provide and improve the Services for you, as described in this Policy.
- We do not use health or fitness data for advertising, and we do not sell it.
- We do not disclose it to third parties except the service providers needed to operate the Services (such as our hosting and database providers), for legal/safety reasons, or with your direction or consent.
- If you connect Apple Health or Google Fit, our use of that data complies with Apple's HealthKit and Google's Fit / Health Connect requirements, including their limited-use rules. You can disconnect these integrations at any time in your device settings.

7. Your privacy choices and rights
Depending on where you live, you may have some or all of the following rights, subject to legal limits:
- Access the personal information we hold about you and obtain a copy.
- Correct inaccurate or outdated information (you can update much of it directly in the app).
- Delete your personal information.
- Opt out of the "sale" or "sharing" of personal information and of targeted advertising. Hercules does not sell or share personal information for targeted advertising, so there is nothing to opt out of today; if this changes, we will provide a clear opt-out, including support for the Global Privacy Control (GPC) where required.
- Limit the use of sensitive personal information (we already limit such use to providing the Services, as described above).
- Withdraw consent where we rely on consent, without affecting prior processing.
- Non-discrimination — we will not discriminate against you for exercising your rights.
- Appeal a decision we make about your request, where applicable.
How to exercise your rights. You can manage and update much of your information in the app. You can delete your account in the app or by emailing support@joinhercules.fit. To make any other request, email support@joinhercules.fit. We will verify your request (for example, by confirming control of your account phone number or email) and respond as required by law. You may use an authorized agent where the law permits.
Marketing choices. You can unsubscribe from marketing emails using the link in any such email; you will still receive non-promotional service messages. We currently send transactional SMS only (such as login codes) and do not send marketing texts or push notifications.
8. Account deletion
You can delete your account at any time:
- In the app, through your account settings; or
- By email, by contacting support@joinhercules.fit.
When you delete your account, we delete or de-identify your personal information, except where we must retain it to meet legal, tax, security, or dispute-resolution obligations. Some information may persist for a limited period in backups before it is overwritten.
9. US state privacy rights
Residents of certain US states — including California, Colorado, Connecticut, Virginia, and other states with comparable laws — have the rights described in Section 7, and we honor them regardless of your state of residence.
- California (CCPA/CPRA). We do not "sell" or "share" personal information as those terms are defined under California law. California residents have the right to know, access, correct, delete, and limit the use of sensitive personal information, and the right to non-discrimination. You may also designate an authorized agent.
- Sensitive personal information. We collect health/fitness data and similar information that may be "sensitive." We use it only to provide the Services and do not use it for purposes that would require an opt-out (such as advertising).
- Opt-out preference signals. Where required, we will honor recognized opt-out signals such as the Global Privacy Control (GPC).
Consumer health data (Washington, Nevada, and similar laws)
Some states — such as Washington (My Health My Data Act) and Nevada (SB 370) — provide specific rights regarding consumer health data. Where these laws apply to you:
- We collect health data (as described in Sections 2 and 6) only to provide the Services to you, and with your consent where required.
- We do not sell consumer health data, and we do not share it for advertising.
- You may access or request deletion of your consumer health data, and withdraw consent, by contacting support@joinhercules.fit.
10. Data retention
We keep your personal information for as long as your account is active and as needed to provide the Services. After that, we retain information only as necessary to comply with our legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements, after which we delete or de-identify it.
11. Security
We use administrative, technical, and physical safeguards designed to protect your personal information, including access controls and reputable infrastructure providers. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. If we become aware of a security incident affecting your information, we will notify you and the authorities as required by law.
12. International users
The Services are intended for users in the United States, and your information is processed and stored in the United States by us and our service providers. We do not direct the Services to users outside the United States. If you access the Services from another country, you do so on your own initiative and are responsible for compliance with local law.
13. Children's privacy
The Services are intended only for people who are 18 or older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will delete it and terminate the account. If you believe a minor has provided us information, contact support@joinhercules.fit.
14. Third-party services
The Services may link to or integrate with third-party services we do not control (for example, Stripe, the Apple App Store, Google Play, and — if you connect them — Apple Health or Google Fit). This Policy does not cover those third parties' practices. We encourage you to review their privacy policies.
15. Changes to this Policy
We may update this Policy from time to time. If we make material changes, we will provide notice as required by law — for example, by posting the updated Policy with a new "Last Updated" date or by notifying you in the app or by email. Changes take effect when posted unless stated otherwise. Your continued use of the Services after changes take effect means you accept the updated Policy.
